The argument they used, isn't an argument at all! When you've recieved your device, it should work properly.

It sounds like they have fobbed you off with a lame excuse. The phone should be fully working, no excuses.
Contact the care point and ask to speak to the manager and politely demand that it's either fixed or replaced with a new one or you will be complaining to Nokia. Care points are independent companies that have permission to use nokia's name for repairs, they are not owned or run by nokia.
If they fail to help contact nokia care in your country and ask for the complaints address. Now write a polite letter of complaint detailing the service and excuses. This does need to be done by letter, not email or phone.
They will reply and will try to resolve the matter for you. It sucks and you shouldn't have to do this but other than taking legal action against the care point you are out of options.

same problem with my e52...
first, it hangs. couldnt turn it off, so had to take battery out and put it back it. when switching it back on, it would vibrate but it remains turned off. would turn on after several attempts (and after getting super annoyed!)
now the charging issue! it keeps on saying, phone not charging! realized it was a common issue with e52. brought to nokia "care" center. told them the problem. after one day it was ready for pick up. i think they just upgraded the software to version 34.00. and forgot about the REST of the problem. when i got my phone back, battery was almost drained! "care" specialist said that it just needed to be charged (then why didnt they charge it there to see if it worked?!) and NOW SAME PROBLEMS when i got back home . they didnt seem to CARE enough to see/diagnose the real problem.
im so irritated because they had to reformat my phone, so all my contacts, notes, etc were lost. and now, i have to go back there to get this thing fixed again! and after reading this thread (which im sure they are aware of the common problems of e52 AND THE SOLUTIONS to it), im sure they have to change the board too.
i love my e52. everything about it seems perfect for my needs. but they need to improve on its parts and "caring" for our valuable time.

I bought the E52 in october 09. Feb 10 the mother board died. Got it back after one month. July 30th the new motherboard died. I have no phone at the present time. I want nokia to so someting about this. The warranty will be over in a few months. I have little confidence.

DONT give up and chase them.... E52 is indeed a failed model and only if you insist they do something about it.
I have brand new Nokia e52 for past few weeks and its gone dead twice and its been with Nokia more than with me... they are neither ready to give details of problem nor ready to return the services handset... am left with no choice but to file legal complaint against them for not giving solution as well as not even returning handset...... SHAME on nokia for such a pathetic service

I got the same problem with my E52.... I'm about to be convinced that it is a FAILED model by Nokia.
I formatted the hard desk by (*+3+talk) two days before but the same problem exists. I'm afraid of the need to change the mother board as my guarantee is expired!!!!
