Lumia 800 - Battery Issue Software or Hardware problem?

I have the Nokia Lumia 800. Went to sleep with battery at full charge and woke up 8hrs later with it dead and not turning on. Got it to switch on eventually. Now my question is is this software or a hardware issue? As in will it fix with the new update coming or do i go get a new Lumia? I have read in the battery topics that people swap it to find the same issue. Also anyone have any idea when the update will reach Australia? Thanks.
